2. USERS

 

The access and/ or use of this Portal of the Equilibri Foundation attributes the condition of USER, who accepts, from said access and / or use, the General Conditions of use reflected here. These conditions will be applied regardless of the General Contracting Conditions that, where appropriate, are mandatory. The user certifies that he is over 14 years of age and therefore has the necessary legal capacity to give consent to the processing of his personal data.

3. USE OF THE PORTAL

 

RBIU.org provides access to a multitude of information, services, programs or data (hereinafter, “the contents”) on the Internet belonging to the Equilibri Foundation or its licensees to which the user may have access. The user assumes responsibility for the use of the portal. This responsibility extends to the registration that is necessary to access certain services or contents. In this register the USER will be responsible for providing truthful and lawful information. As a result of this registration, the USER can be provided with a password for which he will be responsible, committing himself to make diligent and confidential use of it. The user undertakes to make appropriate use of the contents and services (such as chat services, discussion forums or newsgroups) that the that the Equilibri Foundation offers through its portal and, by way of example but not limited to, not to use it to (i) engage in illicit activities, illegal or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic-illegal nature, of apology of terrorism or that violates human rights;   (iii) cause damage to the physical and logical systems of the Equilibri Foundation, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage;  (iv) attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages. The Equilibri Foundation reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, public order or security or that, in his opinion, will not be suitable for publication.  In any case, The Equilibrio Foundation will not be responsible for the opinions expressed by users through forums, chats, or other participation tools.

 

4. DATA PROTECTION

 

To use some of the Rbiu.org services, users must provide us with personal data. Therefore, Rbiu.org will automatically process Personal Data in compliance with the European Data Protection Regulation (GDPR) 2016/679, of 27 April 2016. At Rbiu.org we ensure the correct use and processing of your personal data. All communications of personal data are made with maximum security, with a valid security certificate in the name of Rbiu.org Personal data will be incorporated into the file/s “web users”, created and maintained under the responsibility of The Equilibri Foundation, owner of the website Rbiu.org, which has been duly registered with the Spanish Agency for Data Protection, for the following purposes: (1) resolution of queries; (2) management of the business relationship with the client;  (3) provided that the user has previously requested it, sending advertising and offers of interest. Rbiu.org undertakes to adopt the necessary security measures to prevent the loss, unauthorized access or manipulation of personal data, in accordance with the provisions of Royal Decree 1720/2007, of 21 December. You can exercise your rights of access, rectification, cancellation or opposition by writing to equilibri@fundacioequilibri.org or through our office at Calle Casp 37, 1st 4th, 08010. Your personal data will not be shared with anyone: neither with the collaborating companies nor with the NGOs. By accepting this clause, the USER agrees to receive news, newsletters, offers, promotions and news related to Rbiu.org.

Likewise, the inclusion of these external links will not imply any type of association, merger or participation with the linked entities.

Fundació Equilibri reserves the right to make without prior notice the modifications it deems appropriate in its portal, being able to change, delete or add both the contents and services provided through it and the way in which they are presented or located on its portal. 

 

9. RIGHT OF EXCLUSION

 

Fundació Equilibri reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, on its own or by a third party, to those users who fail to comply with these General Conditions of Use.

 

10. GENERALITIES

 

The Equilibrio Foundation will pursue the breach of these conditions, as well as any improper use of its portal exercising all civil and criminal actions that may correspond to it by law.

 

11. MODIFICATION OF THESE CONDITIONS AND DURATION

 

The Equilibrio Foundation may modify at any time the conditions here determined, being duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will be in force until they are modified by others duly published.

 

12. APPLICABLE LEGISLATION AND JURISDICTION

 

The relationship between The Equilibrio Foundation and the USER will be governed by current Spanish regulations and any controversy will be submitted to the Courts and Tribunals of the city of Barcelona.
